Title 8, Chapter 12, US Code 1182 Authorizes Trump to Restrict Immigration

This week the US Supreme Court issued a 5-4 ruling upholding President Trump's policy of temporary restricted travel from a handful of countries liberals call "Muslim majority countries."  The Court ruling highlights two key points: 1) the President does actually have the ability to set definitive policy on who may or may not enter the country, based on national security, and 2) the Left is still at war with facts.

Federal law specifically grants the President direct control of this issue. Title 8, Chapter 12, US Code 1182 states:

"Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate."

This statute conveys all authority to the President in setting restrictions on who may enter the country, which is exactly what President Trump did. 

The countries included in the travel ban were Iraq, Iran, Chad, Libya, Somalia, Sudan, Syria and Yemen. Those countries were selected because of issues they have with vetting, appropriate security procedures at their ports of entry and exit and forging official documents (ie: passports). It is nearly impossible to verify the identities of people coming from those countries, under such circumstances. They were also selected because they were deemed security threats by the Obama administration not only for their issues with identity fraud, but also terrorism and other issues.

The countries with the highest Muslim populations are Indonesia, Pakistan, India, Bangladesh, Egypt and Turkey. It stands to reason that if the real intent of the Trump administration were to ban Muslims, they would have targeted the countries with the highest Muslim populations. The true effect of this travel ban is that roughly 90% of the world's Muslim population is totally exempt. Most Muslims worldwide are free to enter the United States at will and have no restrictions whatsoever. Therefore, the characterization of this policy as a "Muslim Ban" is an outright lie.

These are the facts surrounding this issue. But, to the Left facts be damned.

The Left's Ongoing War With Truth

Leftist extremest Linda Sarsour highlighted the inability of the Left to comprehend basic facts, with her response to the Supreme Court ruling posted on Twitter, saying: "Sitting in my daughter's high school graduation in tears. I have to tell my daughter who has been asking me for updates that #SCOTUS upheld the Muslim and Refugee Ban. That they decided on the side of xenophobia and racism. Devastated. #StandWithMuslims #NoMuslimBanEver"

The disingenuous nature of her post cannot be overstated. Nothing about the travel ban was racist because: 1) Muslims aren't even a race and 2) no group of people was targeted based on race, religion or other immutable characteristics. What Sarsour did with this statement exemplifies the new hallmark of the Left: call everything with which they disagree racist, xenophobic, homophobic or Nazi-like, even if there is no evidence to support that position.

Adding to the idea that President Trump's motives in issuing the travel ban really are based around security for the nation and not xenophobia is that fact that both Chad and Iraq were removed from the banned list after updating security processes for their countries. In fact, the White House released a statement in April, which said, "President Donald J. Trump signed a proclamation today announcing that the Republic of Chad has improved its identity-management and information sharing practices sufficiently to meet the baseline security standard of the United States.  Chad nationals will therefore again be able to receive visas for travel to the United States."

This underscores that which is obvious to anyone even remotely objective: the travel ban is strictly about security, not religion. Democrats, the alleged party of facts and reason, simply choose to ignore the White House statement, the removal of two countries from the ban and any other factual information that fails to support their narrative.

With calls for civility in a nation that is increasingly ratcheting up the potential for violence, proper contextualization of inflammatory issues are crucial to maintaining peace and security. People like Linda Sarsour and other leading Democrats who constantly scream racism and xenophobia are not throwing gasoline onto an already raging fire, they are essentially adding gasoline to a fire they built themselves.
